19일 블룸버그통신 등에 따르면 스위스 최대 은행인 UBS는 미 법무부와 국세청(IRS)의 압력에 굴복, 탈세 혐의가 있는 미국인 고객의 신상 및 계좌 정보를 제공키로 했다.

UBS는 기소전 합의에서 유죄를 인정하는 대신 250명의 계좌 정보를 미국에 제출하고 벌금으로 7억8000만달러를 지급키로 했다.

미 관계 당국은 UBS가 비밀 계좌 개설을 통해 미국 부유층이 자산을 은닉하는 것을 돕고 있으며 이를 통해 매년 3억달러 규모의 탈세가 이뤄진다고 보고 조사를 벌여왔다.

스위스은행의 비밀 유지 관행은 17세기부터 시작됐다. 종교박해를 피해 스위스로 이주해온 프랑스 위그노 신자들이 모국의 고객을 대상으로 비밀리에 은행업을 하며 전통은 시작됐다.

이후 1930년대 독일 나치정권이 중립국인 스위스의 은행들에 대해 유태인에 관한 정보를 공개하도록 압력을 가하자 스위스 의회는 아예 비밀주의 원칙과 관행을 입법화해 명문화했다.

이에따라 스위스 정치권 등지에서는 UBS의 정보공개가 스위스 은행 산업을 붕괴시킬 수 있다며 제동을 걸 움직임을 보이고 있다. 또 일부 고객들도 정보를 공개할 경우 자금을 다른 조세회피 지역으로 옮기겠다고 위협하고 있다.

하지만 피터 쿠렐 UBS 회장은 성명을 통해 "UBS는 부적절한 행위에 대해 책임을 받아들이기로 했으며, UBS의 고객 비밀 보호 조항은 사기 행위를 한 고객들과 이를 악용하는 고객들을 따로 구분해서 적용해야 한다"고 밝혔다.

스위스 금융감독 당국도 성명을 통해 UBS의 공개 조치 조항을 환영하며, 이번 조치가 UBS의 형사 고발을 피하도록 도와줄 것이라고 설명했다.

일단 이번 UBS의 정보 공개는 미 사법당국과의 형사 합의에 따른 결정이다. 그러나 IRS가 제기한 민사 소송이 또 계류 중이어서 이와 관련한 추가적인 정보 공개 소환장이 조만간 발부될 것으로 보인다.

이 경우 UBS는 IRS가 탈세 혐의로 조사하고 있는 1만9000명에 달하는 고객 자료를 제출해야 한다.


한편 400년을 지켜온 스위스은행들의 비밀 유지 관행이 일단 깨지며 이를 선례로, 탈세 및 비자금 수사에 어려움을 겪고 있는 각국 정부들의 비밀 공개 요청도 이어질 것으로 보인다

(서울=연합뉴스) 김정일 북한 국방위원장이 해외에 강제로 도피하는 비상상황에 대비, 미화 40억달러(약 4조5천300억원)에 달하는 비자금을 유럽 은행에 몰래 예치하고 있다고 영국 일간 텔레그래프가 14일 보도했다.



텔레그래프는 한국의 정보관계자들과 국제인권운동가들을 인용해 김 위원장의 비자금에 대한 동결조치가 내려지면 김 위원장이 핵무기를 포기할 수밖에 없을 것이며 북한 주민들이 비자금 존재를 알게 되면 정권에 저항하는 봉기가 일어날 가능성이 있다고 전망했다.

이 신문은 스위스 당국이 자금세탁 규제를 강화하기 전에는 북한이 비자금 대부분을 스위스 은행에 예치했었으나 규제 강화를 계기로 기록을 남기지 않으려고 비자금을 현금으로 인출, 룩셈부르크의 은행으로 이체했다고 한국 정보기관 관계자가 말했다고 전했다.

북한 비자금의 룩셈부르크 은행 이체와 관련, 가토 켄(加藤健) 아시아 국제인권 대표는 "이것은 조직범죄 역사상 최대 규모의 돈세탁"이라면서 "하지만 비자금의 최종 목적지는 자금 규모에 상응하는 주목을 아직 받지 않고 있다"고 지적했다.

가토 대표는 "김정일의 비자금을 숨겨주면서 막대한 수익을 올리려는 은행가들은 세계 어딘가에 있다"면서 "비밀 은행계좌가 현재 룩셈부르크에 있거나 최근에 룩셈부르크에서 다른 조세피난처로 계좌가 옮겨졌다고 믿고 있다"고 말했다.

'더러운 거래:국제자금세탁 말하지 않은 진실, 국제범죄와 테러리즘'의 저자인 피터 릴리 역시 무아마르 카다피 리비아 국가원수와 사담 후세인 전 이라크 대통령이 룩셈부르크 은행들을 자금세탁 거점으로 이용한 증거가 있다고 지적했다.

이에 대해 룩셈부르크 정부의 한 대변인은 북한과 관련된 모든 거래는 법적으로 조사하도록 의무화돼 있다며 룩셈부르크 은행에 북한 비밀계좌가 있다는 주장을 반박했다.

하지만, 이 대변인은 "그들(북한)은 가능한 한 연계 가능성을 없애 (증거를) 숨기려고 하고 있다"며 북한 비자금의 출처를 파악하기 쉽지 않다고 털어놓았다.

가토 대표는 또 "김정일의 40억달러 비밀계좌가 동결된다면 역사의 흐름을 바꿀 수 있을 것"이라며 "김정일은 고위관리들의 충성심을 사기 위한 자금이 필요하기 때문에 핵무기를 포기하고 국제사회에 자금동결 해제를 애걸할 수 밖에 없을 것"이라고 덧붙였다.

텔레그래프는 김 위원장의 막대한 비자금은 핵무기와 미사일 기술판매와 마약 거래, 보험사기, 외국화폐 위조를 통해 얻은 수익금으로 만들어진 것이라고 설명했다.

이와 함께 텔레그래프는 한국의 정보관계자가 "북한 주민들이 이 자금의 존재를 알게 된다면, 봉기해 북한 정권에 저항할 가능성이 있다"고 말했다고 전했다.

빗장 풀리는 스위스 비밀계좌 내막

검은 돈 '무풍지대' 옛말…稅 탈루자 '나! 떨고 있니?'



2차 대전 이후 금융 비밀주의를 내세워 세계적으로 ‘검은 돈 창고’ ‘비밀금고’라는 오명을 짊어졌던 스위스의 금융 비밀계좌가 마침내 베일을 벗을 전망이다. 그 동안 세계의 악명 높은 독재자들이 단골로 이용하던 스위스 비밀계좌와 금고는 더 이상 무풍지대도 안전지대도 아니다.
미국은 지난 9.11테러 사건 이후 스위스 당국에 테러자금으로 의심되는 계좌 정보 일체를 제공해 줄 것을 의뢰했고 스위스 당국이 이를 전폭적으로 수용해 화제가 된 바 있다. 미국은 또 스위스의 비밀주의 금융 방식이 국제적으로 악용되는 사례에 대해 우려를 표명하며 공개적으로 제동을 걸기도 했다.
스위스는 중립국가로 정치적 문제에 개입하지 않으며 독재자건 살인자건 불문하고 입금되는 돈에 대해서만 철저히 예금자의 신원을 보장, 비밀에 부쳐 왔다. 그러나 최근 과거의 오명을 벗어나려는 움직임이 적지 않다. 스위스 당국은 굳게 닫혔던 금융 빗장을 일부 국가들에게 서서히 열면서 금융거래 정보를 원할 경우 이를 제공하기 시작했다.

지난 반세기 동안 스위스는 국제 금융거래 시장의 ‘무풍지대’나 다름없었다. 철저히 예금자의 신원을 보호하는 원칙으로 세계의 검은 돈이 몰려들었고 스위스 당국은 이렇게 몰려든 막대한 자금으로 국가 산업에 재투자해 엄청난 이익을 누렸다.
그러나 스위스는 ‘검은 돈의 집합지’라는 오명도 함께 얻었다. 전 세계 독재자들은 스위스 은행을 선호했다. 사람을 죽이고 국민의 혈세를 빼돌려 자신들의 부를 축적하는 수단으로 스위스 은행을 애용해 왔으며 당국은 이들의 신원을 철저하게 보장해줬다.
특히 한국에서는 박정희 정권 이후 정·재계 실력자들이 스위스 은행을 앞 다퉈 이용해 왔다. 이후락 전 중앙정보부장을 비롯해 김형욱 부장이 스위스에 비밀계좌를 운용하고 있었다는 증언은 미국 청문회에서도 나온 바 있다. 이처럼 독재치하에서 정권 유지를 위해 권력자들이 스위스 은행과 비밀 거래를 한 사실은 공공연한 비밀인 셈이다.
또 한국 재벌가들은 세금 탈루 목적으로, 정치인들은 검은 돈을 세탁하기 위해 스위스 은행이나 조세 피난처(Tex Heaven)를 이용해 왔다. 그러나 이제는 모두 옛말이 될 처지다.

역외탈세자 부분 공개

한국정부는 지난 1일 한-스위스 조세조약에 금융정보 교환 규정을 추가 삽입해 논의 중이라고 발표했다. 정부는 이르면 내년 초부터 우리나라 탈루자들이 스위스 비밀금고에 숨겨놓은 자금 내역을 의뢰해 부분적으로 공개할 예정이다.
이번 한-스위스 조세조약 가운데 금융 정보 규정을 삽입한 이유는 재정위기에 처한 각국 정부가 세금추징을 위해 해외 금융거래 정보를 상호 교환하기로 한 데 따른 것이라는 분석이다. 이번 협약은 오는 7월 스위스에서 양국 간 최종 합의에 이를 가능성이 크며 스위스 정부도 상당히 긍정적인 반응을 보이고 있다.
재정부의 한 고위 관계자는 "그 동안 우리 측 협상 제의에 미온적이었던 스위스 당국이 7월 스위스에서 만나 최종 조율하자는 의사를 전달해 왔다"라며 "그 전에 실무진끼리 세부 협의를 마치고 7월에 최종 합의에 이르는 쪽으로 추진하고 있다"고 밝혔다.
이 관계자는 "우리가 미국처럼 특정 범위를 지정해 스위스에 계좌 내역을 요구하기는 어려운 상황이라 세금 탈루 의혹자로부터 받은 스위스 계좌에 대해 내역을 의뢰해 통보받는 수준이 될 가능성이 크다"고 말해 그 동안 스위스나 기타 조세 피난처 국가에 검은 돈을 거래한 사람들의 신상이 밝혀질 것으로 기대하고 있다.
정부는 오는 7월 한·스위스 조세협약이 합의될 경우 양국 간 세부 비준 절차 등을 거쳐 내년 초부터 스위스와 금융정보 교환이 가능할 것으로 보고 있다. 이에 따라 금융 비밀주의를 악용한 역외 탈세가 차단될 수 있을지 주목된다.









무기 브로커들 천국

과거부터 일부 국내 부유층이 스위스 은행에 거액의 재산을 관리하고 있다는 의혹은 끊임없이 나돈 바 있다. 그러나 스위스와 금융정보 교환이 불가능해 숨긴 재산을 파악할 수 없었다.
여기에 한국의 경제성장과 맞물려 외국 기업에서 받은 리베이트를 한국 정부에 신고하지 않고 세금을 탈루할 목적으로 스위스은행을 거래하고 있다는 정보도 속속 입수돼 한국정부가 대대적인 단속에 나서 의혹인물들에 대한 신상정보와 거래 사실을 의뢰할 예정이다.
한-스위스 정부의 조세조약 중 금융정보 교환 내용이 포함되었다는 소식에 세금 탈루 사업가들과 재벌 기업들이 초비상이 걸렸다는 후문이다. 금융정보 교환이 이뤄질 경우 국내의 세금 탈루 혐의자로부터 넘겨받은 스위스 계좌에 대한 내역 조사를 통해 추징이 가능해지며 스위스 금고도 더 이상 안전하지 않다 것이다.
지난 70년 대 초 중동 개발 붐 이후 한국 기업들이 브로커들이 세금 탈루나 정치자금 마련을 위해 탈세나 세탁을 목적으로 스위스-홍콩, 최근에는 조세 피난처를 즐겨 애용해 왔었다. 특히 전두환 군부정권 이후 검은 정치 자금들이 예치되었으며 원자력 발전기 도입과 무기브로커, 오일 회사와 브로커들이 리베이트로 받은 검은 돈들이 주로 예금되었다는 의혹이다.
실제로 지난 10여 년간 한국에서 터진 대형 금융사건이나 정치적 사건에 스위스의 검은 돈 거래 사실들이 속속들이 밝혀졌으나 한-스위스 당국 간의 범인인도협정이나 금융정보 거래 등에 관한 협약이 체결되어 있지 않아 검찰이 곤혹을 치렀다.

DJ 정치자금 겨냥설 대두

정치권에 의하면 김대중 전 대통령의 숨겨 돈의 상당 액수가 스위스의 비밀계좌에 존재해 있을 것이라는 추측이 난무하고 있다. 대북 송금 5억 달러를 제외하고도 아직 밝혀지지 않은 2억 달러가 어딘가에 숨어 있을 것이라는 내용이다.
지난 2006년부터 꾸준히 제기되어 온 뉴욕의 뭉칫돈이 김대중 전 대통령의 가족에서부터 흘러나온 돈이라는 주장과 스위스에 거액의 예금이 예치되어 있다는 주장이 끊임없이 제기되고 실제로 현 정부가 이 돈을 찾기 위해 혈안이 되어 있다는 그럴듯한 소문도 있다.
이번 한-스위스 금융정보 제공 의뢰 1순위가 바로 DJ의 숨겨 논 비자금이라는 소문도 정황 상 사실일 가능성이 많다. 현재 스위스에 예치된 한국의 검은 돈은 수십억 달러로 추산되고 있다. 이미 사망한 사람들의 예금은 모두 스위스 국고에 귀속되었다. 이 돈까지 합치면 지난 반세기 동안 스위스은행에 예치된 검은 돈은 천문학적이다. 이번 기회에 이들의 검은 돈의 행적이 낱낱이 까발려질지는 모르지만 메시지를 통해 역외 탈세를 예방하는 효과가 상당히 있을 것으로 보인다.

BBK 김경준씨, 스위스 구좌에 1500만 달러 있다












이명박 대통령을 비롯한 다수의 투자자들을 상대로 수백억 원 대의 투자사기를 벌여 현재 8년형을 선고받고 서울 교도소에 수감 중인 前 옵셔널벤쳐스 코리아 대표 김경준(40)씨도 스위스 은행의 고객인 것으로 확인됐다.
김씨는 스위스의 한 은행에 1530만 달러를 예치한 사실이 당시 FBI에 의해 확인 돼 수사당국이 김씨의 재산을 동결한 것이 밝혀지면서 세인들의 비상한 관심을 불러 일으켰다. 이 같은 사실이 밝혀지자 이 돈의 실제 주인을 둘러싸고 추측이 난무했다.
재판 당시 연방검찰에 의해 동결된 김 씨 재산 3000만 달러의 출처에 대해 존스 변호사는 “명문대를 나온 능력 있는 사람이 충분히 벌 수 있는 재산이며 동결된 자산은 김경준 씨가 합법적인 방법을 통해 노력해 벌은 돈”이라고 강조했다.
그는 문제의 자금이 옵셔널벤쳐스 코리아의 투자사기와는 아무런 연관이 없음을 강력히 주장했으나 당시 김씨의 세무보고 자료에 의하면 터무니없는 액수라는 사실이 드러나 논란이 됐다. 이를 놓고 문제의 자금이 제3의 정치인의 비자금이라는 주장도 나왔다.
당시 연방검찰이 제출한 보석불허 관련 자료에 의하면 “김씨가 스위스 은행에 예치된 예금을 2002년 3월 12일부터 올해 3월 1일까지 5차례에 걸쳐 알렉산드리아 인베스트먼트 LLC.명의로 크레딧 스위스 프라이빗 은행에 총 1,530만 달러를 입금시킨 기록이 있다”는 내용을 담고 있는 것으로 알려졌다.
지난 2001년 12월 20일 도망치다시피 LA로 도주한 김씨가 불과 2년 만에 무슨 재주로 수천만 달러의 거액을 벌었는지 모를 일이지만, 스위스 비밀은행에 예치된 돈의 성격 등 정황을 보아 제3자의 빼돌린 검은 자금과 무관치 않음에 의혹은 여전하다.





스위스 은행들 검은돈 16억 달러 돌려줘

(워싱턴) 제3세계 독재자들과 악질 정치인들의 ‘불법 비자금 은닉처’로 악명높은 스위스 은행들이 그간의 오명을 씻기위해 노력하고 있다고 미국 언론들이 보도했다.

스위스는 최근 몇 년 동안 스위스 은행에 은닉돼 있던 16억 달러 규모의 불법자금들을 해당 국가에 되돌려 주었다고 연방 외교부 파울 세게르 국제법 담당 대사가 12일 밝혔다.

워싱턴을 방문 중인 파울 세게르 대사는 기자들과 만난 자리에서 “스위스는 나이지리아 독재자였던 사니 아바차와 관련된 7억 달러, 필리핀 독재자였던 페르디난도 마르코스가 은닉해둔 6억 8,000만 달러를 두 나라의 민주 정부에 돌려주었다”고 밝혔다.

그는 또 아이티의 장-클로드 뒤발리에와 자이르의 모부투 세세 세코의 사건으로 스위스는 오명을 입었으나 모두 해당 나라들의 새로운 정부에 제공했다고 말했다.

한편 스위스는 ‘돈세탁 방지법’을 제정, 돈세탁 신고청을 설립해 모든 정보를 제공하고 있다. 최근 스위스 연방 정부는 스위스 은행들에게 PEP(정치적으로 노출된 사람들) 를 조심하고 ‘당신의 고객을 알라’는 지침을 내려 불법자금을 찾아내는데 노력하고 있다고 설명했다.

한편 미국 언론들과 www.usinsideworld.con 취재진이 “스위스 은행에 예치된 김정일 불법자금 50억 달러와 한국 정치인 권노갑, 김대중, 박지원, 김영완, 조풍언의 은닉 예치에 대해 설명해 달라”고 요구하자 스위스 대사관 관계자는 “제네바에 있는 돈세탁 신고청에 서면으로 질의하면 답을 얻을 수 있을 것”이라고 답했다.

스위스 은행은 한마디로 '검은 돈의 은신처'다.

고객 이름 없이 숫자와 문자가 조합된 계좌번호만으로 비밀계좌를 관리하고 있다. 이 때문에 전 세계 부유층들은 스위스 비밀계좌로 세무당국의 눈을 피해 재산을 빼돌렸다. 이에 따라 국제 마피아, 각국 독재자들의 부정축재자금의 은신처로 각광받고 있다.

국내에서도 노태우 전 대통령, 정태수 전 한보그룹 회장 등의 스위스 은행 비자금 설이 쏟아져 나왔다. 그러나 스위스 은행의 비밀주의에 따라 진실이 제대로 파악되지 않는 것도 특징이다. 전문가들은 현재 약 1,200억 달러 정도의 '검은 돈'이 스위스 은행의 비밀금고에 숨겨져 있을 것으로 추정하고 있다.

필리핀의 독재자였던 페르디난드 마르코스 전 대통령이 스위스 은행의 단골 손님으로 유명하다. 필리핀 정부는 무려 18년에 걸쳐 마르코스가 스위스 은행에 숨긴 6억2,400만 달러를 되찾는데 성공했다. 관심을 끄는 것은 마르코스가 북한 김일성 주석 명의로 차명 비밀계좌를 만들기도 했다는 점이다.


2002년 국내 한 언론 보도에 따르면 1994년 사망한 북한 김일성 주석 명의로 스위스 최대은행인 UBS에 80억달러 상당의 비밀계좌가 개설돼있는 것으로 알려져 화제를 모았었다. 김일성 명의의 이 계좌는 마르코스 전 대통령이 생전에 자신의 비밀계좌의 안전을 위해 차명으로 개설한 것이며 비밀계좌 예치증서 사본에는 UBS에 김일성의 이름으로 순도 99.9%의 금괴 940t이 예치된 것으로 나타났다.

이에 대해 마르코스 전 대통령의 측근은 "필리핀에서 1986년 망명, 89년 사망한 마르코스 전 대통령이 비밀계좌를 타인이 인출하지 못하도록 제3세계의 독재자 이름을 차용하는 수법을 사용했다"며 "차명 대가로 김일성 주석에게 반대급부를 줬는지, 김일성 주석에게 차명계좌를 개설한다는 사실을 통고했는지 여부는 확실치 않다"고 밝히기도 했다.

북한 김정일 국방위원장도 스위스 은행의 '검은 손'으로 지목되고 있다. 미국은 2006년 김정일 국방위원장이 스위스 은행에 40억 달러의 비밀계좌가 있다며 필요에 따라 조사할 수도 있다고 밝혔다. 북핵 등에 대한 압박카드로 비밀계좌를 조사할 수 있다는 뜻이다.

사망한 사담 후세인 이라크 전 대통령도 비밀계좌로부터 떳떳하지 못하다. 외신은 한 은행가가 스위스 은행 등에'사탄'이라는 가명으로 후세인 대통령의 비밀계좌를 만들어 재산을 관리해줬다고 전했다. 이 신문은 "은행가가 후세인 대통령의 계좌를 관리해 준 사실을 인정하면서 마피아 대부나 마약 거래상들의 계좌를 관리해 주는 것보다는 덜 나쁜 일로 생각한다"고 말했다고 보도했다. 미국 등은 세계 각국에 숨겨져 있는 후세인 대통령의 재산이 우리 돈으로 적게는 700억원에서 많게는 2,000억원이 넘을 것이라고 추정해왔다.

천수이볜(陳水扁) 전 대만 총통도 부정축재로 악명이 높다. 천 전 총통의 며느리 황루이징의 명의로 크레디스위스은행 계좌에 있는 2,000여만 달러 외에도 5,000만 달러에 달하는 천 전 총통의 해외 비밀계좌가 발견됐다. 이 계좌에서 1,700만 달러를 인출한 사실이 확인되기도 했다. 알베르토 후지모리 전 페루 대통령의 전처인 히구치 여사는 후지모리 대통령이 스위스 은행 비밀계좌에 예치한 7,000만 달러를 폭로하기도 했다.

스위스 은행의 비밀계좌는 한국도 예외가 아니다. 이후락 전 중앙정보부장이 박정희 전 대통령의 스위스 은행 비밀계좌를 관리했다는 여러 증언이 나오기도 했다. 또 지난 1995년 터진 노태우 전 대통령의 비자금 파동과 재산이 29만원 밖에 없다고 말한 전두환 전 대통령과 관련해서도 스위스 은행 비밀계좌 존재설이 수차례 제기됐으나 확인된 사실은 없다. 이밖에 정태수 전 한보그룹 회장과 그의 아들 한근씨는 회사돈 3,270만 달러를 스위스 은행의 비밀계좌로 빼돌린 혐의로 검찰 수사를 받기도 했다.

또 'BBK주가조작 의혹 사건'의 핵심인물인 김경준씨도 스위스 은행계좌 등에 300억원 상당의 비자금을 감춘 의혹이 있다는 주장이 2007년 국정감사에서 제기됐었다.

위안화의 국제화, 5년내 동남아 유통가능

아세안 10국이 한중일 3국 및 홍콩금융관리국과 치앙마이이니셔티브(CMI)를 정식으로 체결할 것이라고 밝히면서 규모 1200억 달러의 아시아 외환보유고가 정식으로 성립됨을 알림과 동시에 아시아 금융 협력이 한 발 더 전진한 가운데 중국-아세안 자유무역지구 개방 후 위안화의 국제화가 더욱 가속화될지, 기업들은 이로 인해 실질적인 이익을 얻을 수 있을 지가 모두의 관심사로 떠오르고 있다.

중국정법(政法)대학 경제학자 양판(杨帆) 교수는 이에 대해 최근 한 인터뷰에서 “동남아가 우선적으로 위안화를 수용할 것”이라고 밝혔다.

양판 교수는 중국 경제와의 긴밀도가 높은 국가에서 위안화를 수용하는 속도가 더욱 빠를 것이라고 전했다. 현재 홍콩에서 위안화 결산은 이미 실현되었고, 그에 따르면 중국-아세안 자유무역지구가 개방되면서 동남아 국가들이 점차 위안화를 수용하고 있으며, 최종적으로는 일본과 한국이 위안화를 수용하면서 ‘10+3’에서 위안화가 통용될 것이다.
